Terms of service

These terms are an agreement between Alpine Start Studio ("we", "us") and the company that signs up for MapDry ("your company", "you"), and they apply to everyone who uses MapDry on its behalf. By signing up or using MapDry, you agree to them. The person who signs up confirms that they can agree to them for the company.

1. The service

MapDry is software for documenting water damage restoration jobs: a phone app, a web app, and the reports they produce. We may improve and change MapDry over time. If we remove something your company relies on, we'll tell you first.

2. Accounts

Your company's admins decide who joins and what they can do, and are responsible for what people do with your company's account. Keep access to your email secure, since sign-in links go there. Tell us right away at support@mapdry.com if you think someone has gotten into your account.

3. Trial, price, and payment

• New companies get a 14-day free trial. You add a card when you sign up. If you don't cancel before the trial ends, the subscription starts and the card is charged.
• The subscription is $149 a month for the whole company, plus any sales tax, billed monthly in advance through Stripe. It renews each month until cancelled.
• You can cancel any time in Settings → Billing. Cancelling takes effect at the end of the month you've paid for. We don't refund partial months.
• If a payment fails, Stripe retries it for 7 days. After that, or after the subscription ends, your company's account becomes read-only: everything can be viewed, printed, and downloaded, but changes can't be saved.
• We may change the price with at least 30 days' notice by email. The new price applies from your next billing period after the notice.

4. Your data

Your company owns the job records, photos, and everything else it puts into MapDry ("your data"). You give us permission to store, copy, process, and display your data only as needed to provide MapDry to you, including sharing photo links when someone in your company turns them on. Our privacy policy explains how we handle it.

You're responsible for your data and for having the right to collect it, including any permission you need from property owners and others to photograph their property and record their contact details.

After your subscription ends, your data stays readable for 90 days. We email admins 30 days before we delete it. Print or download anything you want to keep before then.

5. Acceptable use

Don't use MapDry to break the law or anyone's rights, to upload malware, to try to get into other companies' data or our systems, to overload or disrupt the service, or to resell it. We may suspend accounts that do, and we'll tell you why unless the law prevents it.

6. Your professional judgment

MapDry records and organizes what your team measures and observes. It doesn't decide when a structure is dry, check your work against industry standards, or replace your professional judgment, and calculations it shows (such as grain depression) depend on the readings entered. You're responsible for drying decisions and for the reports you send.

7. Availability

We work to keep MapDry running and your data safe, with regular backups. The app saves your work on the phone when there's no signal and syncs it later. Even so, MapDry is provided "as is," and we can't promise it will always be available or free of errors.

8. Disclaimers

To the extent the law allows, we disclaim all warranties not stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limits on liability

To the extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, and our total liability for any claim about MapDry is limited to what your company paid us in the 12 months before the claim arose. These limits don't apply to your payment obligations or to liability the law doesn't allow to be limited.

10. Ending the agreement

You can stop using MapDry and cancel at any time. We may end this agreement with 30 days' notice, or right away if you seriously breach these terms. Section 4's rules on your data after the subscription ends apply either way, as do sections 6, 8, 9, and 11.

11. General

These terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules, and disputes go to the state or federal courts there. If we change these terms in a way that matters, we'll email admins at least 30 days before the change takes effect. These terms, with the privacy policy, are the whole agreement between us about MapDry. If a court finds part of them unenforceable, the rest still applies.
